Workers’ Compensation as an Exclusive Remedy
On September 6, 2016, Delaware Governor Jack Markell signed legislation (H.B. 308) amending the state’s workers’ compensation law. House Bill 308 was introduced in response to the recent Delaware Superior Court decision of Simpson v. State of Delaware and Government Employees Insurance Company, 2016 WL 425010 (Del. Super. Ct. Jan. 28, 2016). The bill allows employees injured in a motor vehicle collision during the course and scope of employment the ability to continue to access the employer’s automobile insurance coverage, in addition to workers’ compensation benefits.

Income Withholding and Reporting
The Delaware Division of Revenue has updated its answers to frequently asked questions (FAQs) regarding W-2 and 1099 personal income tax withholding information for the 2017 reporting period. The FAQs note that a regulation will be issued to clarify that Delaware due dates for W-2 and 1099 submissions are the same as the federal due dates. The revised due date for paper and electronic W-2 submissions for tax year 2016 and later is January 31 of the following year. The due date for 1099 submissions are unchanged and remain February 28 for paper and March 31 for online submission.
