Miami Minimum Wage Ordinance Remains Invalid

On February 5, 2019, the Florida Supreme Court dismissed the City of Miami’s petition to review a lower court’s ruling in City of Miami Beach v. Fla Retail Federation, Inc., 233 So. 3d 1236 (Fla. 3d DCA 2017). In that decision, the appellate court held the city’s minimum wage ordinance violated the state’s pre-emption statute located at Fla. Stat. § 218.077, which prohibits municipalities or other local jurisdictions from implementing their own minimum wage rates. Subsequently, the 2016 Miami ordinance to increase the city’s minimum wage remains invalid.
