From the Hotline: Eligibility for Benefits if an Employee Lives and Works in Two Different States

Question: If an employee lives in the state of Pennsylvania, but works in the state of New Jersey at an employer facility, would they be eligible for coverage under the disability plan provided by the state of New Jersey?

Answer: The employment laws (and benefits) apply in the state where the employee works, so in this case, it would be New Jersey, and the employee would be eligible for coverage under the New Jersey TDI program.

In fact, there is even a frequently asked question on the state’s website addressing this as follows:

“Do I have to live in New Jersey to receive temporary disability benefits?
No.  Where you live has no bearing on whether you can receive disability benefits.  The most important eligibility  requirement is that you worked for a New Jersey covered employer.”
