Question: Can you provide an explanation of circumstances that are applicable to the “no docking” rule for salary (exempt) employees?

Answer: In most cases, an employee’s exempt salaried status could be lost if an employer docks the pay of that exempt employee. The only exceptions are deductions for absences of more than one day for personal reasons, deductions for absences of more than one day under the employer’s sickness or disability leave policy, deductions for Family and Medical Leave Act leave, and deductions for violations of major safety rules.
