From the Hotline: Employees/Former Employees and Social Media
Question: May we ask employees to disconnect with former employees on social media once they leave the company?
Answer: This would not be considered a best practice.
While we cannot provide legal advice on this matter and recommend seeking legal counsel prior to relying on this information, for general information we note that while regulations surrounding social media relating to employer/employee relationships focus primarily on unauthorized access or employers requiring access to employee social media sites, our understanding is that the intent of these laws is to protect employee privacy and avoid discrimination. It would appear reasonable that the intent of protecting employee privacy rights would therefore extend to not instructing employees as to whom they may or may not be connected with on social media.
