Question: Can a computer professional work part-time and still be exempt?

Answer: Yes. Whether an employee is considered full-time or part-time does not change the application of the FLSA. A part-time job may be classified as exempt under the FLSA and state laws provided the position meets all of the requirements under the applicable classification laws, including the minimum salary requirement.

It is important to note that the law does not provide special or pro-rated minimum salary requirement for part-time positions. As such, an employee properly classified under the computer profession exemption is required to be paid at least $455 per week on a salary basis or paid on an hourly basis, at a rate not less than $27.63 an hour.
