Question: Are we required to grant an employee’s request for a one-year leave to care for her newborn triplets now that her maternity disability leave is completed? (Our company has under 50 employees and is not subject to Family and Medical Leave Act (FMLA) leave requirements).
Answer: In the absence of an FMLA requirement, the company is not required to extend an employee leave for the care of children once the employee is released from pregnancy disability. Once the leave is completed and the employee is released to return to work, you may reassess the employee’s request and discuss any options you both may find available and acceptable, such as a leave extension or a reduced schedule. Be consistent with your company’s leave policies and past practices for granting time off in order to avoid any appearance of discrimination.
