Background Checks for Applicants with Access to Federal Tax Information
On April 4, 2017, Idaho Governor Butch Otter signed legislation (H.B. 243) authorizing the Idaho Department of Labor to request criminal background checks of applicants and contractors who would have access to federal tax information. The law requires submission of fees and fingerprints, establishes who would receive the criminal background checks, and establishes how the information can be used. Additionally, the law prohibits dissemination of criminal history information, provides for the communication of clearance or denial, and establishes formal review of a denial. The law also affords immunity from liability and establishes that clearance is not a determination of suitability for employment or contracting.
The law is effective July 1, 2017.
