Veterans Preference in Private Employment

On May 26, 2016, Louisiana Governor John Bel Edwards signed legislation (S.B. 72) allowing private employers to adopt an employment policy that gives hiring preference to all of the following:

  • An honorably discharged a veteran.
  • The spouse of a veteran with a service-connected disability.
  • The unremarried widow or widower of a veteran who died of a service-connected disability.
  • The unremarried widow or widower of a member of the U.S. Armed Forces who died in the line of duty under combat-related conditions.

The law goes into effect on August 1, 2016.

Mandated Health Benefits – Reconstructive Breast Surgery

On May 10, 2016, Louisiana Governor John Bel Edwards signed legislation (H.B. 694) regarding health care coverage of reconstructive breast surgeries following mastectomies. House Bill 694 clarifies the required coverage of reconstructive surgeries following mastectomies by removing conflicting provisions and adding definitions.

The law went into effect upon signing.

Certificates of Creditable Health Coverage

On May 10, 2016, Louisiana Governor John Bel Edwards signed legislation (H.B. 816) regarding certificates of creditable health coverage provided by group health plans and certain health insurance issuers.

Current Louisiana law requires a group health plan, and a health insurance issuer offering group health coverage, to provide certification of the period of creditable coverage at various times, including when an individual ceases to be covered under the plan or under a Consolidated Omnibus Budget Reconciliation Act (COBRA) continuation provision.

House Bill 816 instead requires that such certification of creditable coverage be sent no more than 20 days after it is requested by an individual who ceases to be covered under the issuer’s policy or plan.

The law went into effect upon signing.

Insurance Definitions

On May 9, 2016, Louisiana Governor John Bel Edwards signed legislation (H.B. 782) amending certain definitions in the state Insurance Code. The law redefines the terms the “employer”, “small employer”, “small group”, “large employer”, and “large group” for purposes of regulation of health insurance.

The law goes into effect on August 1, 2016.
