Wage and Hour Act Updated
On July 25, 2017, North Carolina Governor Roy Cooper signed legislation (S.B. 82) exempting any employee of a seasonal amusement or recreational establishment from the overtime and recordkeeping provisions under the state’s Wage and Hour Act. The law also removes the requirement to pay seasonal amusement or recreational establishment employees an overtime rate only for hours in excess of 45 per week.
The law is effective January 1, 2018.

National Guard Re-Employment Rights
On July 21, 2017, North Carolina Governor Roy Cooper signed legislation (H.B. 487) clarifying the National Guard re-employment rights and extending the re-employment application period for National Guard members who were injured during state active duty. The law also adds additional protections for active and reserve National Guard members upon early termination of a rental agreement.
The law became effective on July 21, 2017.
