North Dakota Employment Law Update – March 2017
Joint Employer Liability Protection
On March 21, 2017, North Dakota Governor Doug Burgum signed legislation (H.B. 1139) providing liability protection for joint employers. Pursuant to the law, notwithstanding any other provision of law or any voluntary agreement between the U.S. Department of Labor and a franchisee, an employee of a franchisee is not considered an employee of the franchisor.
The law goes into effect on August 1, 2017.

Unemployment Insurance – Electronic Filing Requirements
On March 21, 2017, North Dakota Governor Doug Burgum signed legislation (H.B. 1296) regarding employer unemployment contribution and wage reports. Pursuant to the bill, all employers required to file contribution and wage reports must file them electronically. In addition, all contribution payments must be paid electronically.
The law is effective for tax years beginning after December 31, 2017.
