Portland Ban the Box Ordinance

Effective July 1, 2016, Portland’s Ban the Box ordinance (Ordinance No. 187459) prohibits covered employers from considering an applicant’s criminal history unless a conditional offer of employment has been made. An employer may rescind a conditional offer of employment based upon an applicant’s criminal history if the employer determines in good faith that a specific offense or conduct is job related for the position in question and consistent with business necessity.

With exceptions, the ordinance applies to employers with six or more employees, at least one of who is in a position being performed a majority of time with the City of Portland.
