Unauthorized Deductions from Wages

On July 20, 2016, Rhode Island Governor Gina M. Raimondo signed legislation (H.B. 7254) regarding unauthorized deductions from employee wages. Pursuant to the law, an employer may not deduct or withhold from the payment of wages owed to an employee for the performance of work or other reason set forth in the state’s wage payment law any monies not authorized by federal or state law or by court order without first getting written or electronic approval from the employee.

In addition to any other penalty or enforcement provision set forth in the wage payment law, any employer violating the provisions of this new law will be subject to treble damages, payable to the employee, of the amount not authorized to be deducted or withheld.

The law went into effect upon signing.
