Answer: An employee is entitled to up to 12 workweeks for foster care placement in a 12-month period. An employee’s entitlement to leave for adoption or foster care expires at the end of the 12-month period beginning on the date of the first placement. Each separate request is counted towards the total 12 workweek entitlement.

An employer can seek sufficient documentation to determine if the leave qualifies, such as state or court paperwork that offers placement dates.
