Adjustment of Penalties for Violations of OSH Act

On April 6, 2017, New Mexico Governor Susana Martinez signed legislation (S.B. 229) into law that adjusts the penalties for violations of the Occupational Health and Safety Act (OSH Act) to conform with federal Law and requires the New Mexico Department of Environment to adjust penalties on an annual basis to account for inflation.

The law took effect on the date of signing.

Workers’ Compensation Act Amended

On April 3, 2017, New Mexico Governor Susana Martinez signed legislation (S.B. 155) into law, amending the Workers’ Compensation Act to re-establish return-to-work (a program allowing workers who are unable to perform their usual and customary job duties due to an injury or illness to return to work in a temporary, limited, or light duty capacity while they recover) and clarify benefit entitlement.

The law is effective June 16, 2017.
